Cookies Policy (UE)

What is the purpose of our Cookies Policy?

eMyosound, which manages the website www.emyosound.com, attaches great importance to the confidentiality of your personal data, which we regard as a mark of our reliability and trustworthiness, including in relation to cookies.

As such, our Cookies Policy clearly demonstrates our commitment to ensuring that eMyosound complies with the applicable rules on the protection of personal data and, more specifically, those relating to the cookies used when you browse our website www.emyosound.com.

If you would like information on the other processing of personal data that we carry out, please consult our Privacy Policy, which is available at any time on our website www.emyosound.com.

What is a cookie and does it allow us to identify you directly?

A cookie is a small “text” file placed and hosted by a server on your device (e.g. smartphone, tablet or computer) when you visit a website.

A cookie does not allow us to identify you personally, as it only identifies your device via your IP address, as well as various details relating to your browsing activity (e.g. duration of visit, pages viewed, screen size, etc.).

What is a technical cookie and why do we use them?

The proper functioning of our website www.emyosound.com necessarily involves the use of technical cookies, which we may use without your prior consent, based on our legitimate interest in providing you with a functional website.

For example, a technical cookie allows us to remember your website language and the site’s layout to facilitate future logins and browsing.

Therefore, although we do not recommend it, you can always prevent these cookies from being stored on your device by adjusting your browser settings as follows: Chrome, Microsoft Edge, Safari, Firefox and Opera.

However, in this case, your experience as a visitor may be impaired. To restore a good browsing experience, you will need to re-enable technical cookies.

What is a statistical cookie and why do we use them?

A statistical cookie allows us to analyse how you use a website (e.g. browsing time, pages visited, etc.) in order to improve your experience and provide you with a service tailored to your needs.

We use statistical cookies which are considered by the supervisory authorities to offer sufficient protection of your privacy to be exempt from consent. As such, you cannot object to them via the cookie banner.

However, we also use statistical cookies that are not exempt from consent, which may only be placed on your device with your prior consent, given via our cookie banner.

What is an advertising cookie and why do we use them?

An advertising cookie can be used either to display adverts on a website or to identify the source from which a visitor arrived at a site (e.g. Google, Bing, etc.).

We use advertising cookies to display advertisements on our website on behalf of advertisers. Advertisers offer us these advertisements based on cookies that you have also accepted on other websites.

We also use advertising cookies to be listed on search engines (e.g. Google, Bing, etc.) and to identify the source from which a visitor arrived on our website.

Advertising cookies, used both for search engine optimisation and to display advertisements on our website, are only placed on your device with your prior consent, provided via our cookie banner.

What personal data do we process using our cookies, and for how long?

The personal data processed by the cookies we use are:

  • your IP address and a user ID that we create when you first log in, in order to recognise you for a maximum period of 13 months
  • if you accept the use of statistical cookies, your personal data relating to your browsing on our website (e.g. pages visited, browsing duration, etc.) for a maximum period of 13 months, which is not renewable until you log in again before the 14th month
  • in the context of the use of statistical cookies exempt from consent, only your IP address, which is then anonymised and therefore unusable.
  • If you accept search engine referral cookies to identify the source of your visit to our website, your IP address, your user ID and the site visited for a maximum period of 13 months, non-renewable prior to any new connection before the 14th month
  • If you accept advertising cookies to display targeted adverts on our website, your IP address, your user ID and any necessary browsing data, in particular to display the advert on your device in the correct format, for a maximum period of 13 months, non-renewable, prior to any new connection before the 14th month

Once the retention periods specified below have expired, we do not retain any data concerning you. At most, we may anonymise your data for statistical purposes.

How do you control the use of cookies?

You may refuse cookies at any time via our cookie banner.

If the cookie banner no longer appears, you can also manage your cookie settings via the “Manage cookies” tab on our website or directly in your browser by following the instructions below: Chrome, Microsoft Edge, Safari, Firefox and Opera.

What rights do you have to control the use of your personal data collected via cookies?

The applicable data protection regulations grant you specific rights which you may exercise at any time and free of charge to control how we use your data.

  • The right to access and obtain a copy of your personal data, provided that such a request does not conflict with trade secrets, confidentiality, or the secrecy of correspondence.
  • Right to rectify personal data that is inaccurate, out of date or incomplete.
  • Right to object to the processing of your personal data where such processing is based on our legitimate interests, unless there are legitimate and compelling reasons justifying such processing that override your interests, rights and freedoms.
  • Right to request the erasure (“right to be forgotten”) of your personal data that is not essential to the proper functioning of our services.
  • The right to restrict the processing of your personal data, which allows you to monitor the use of your data in the event of a dispute regarding the lawfulness of such processing.
  • Right to data portability, which allows you to retrieve some of your personal data so that you can easily store or transfer it from one information system to another.
  • The right to provide instructions regarding the handling of your data in the event of your death, either directly or through a trusted third party or a beneficiary.

For a request to be considered, it is essential that it is made directly by you or your representative at gdpr@emyosound.com.

Requests cannot be made by anyone other than you or your representative. We may therefore ask you to provide proof of identity if there is any doubt as to the identity of the applicant, as well as proof of representation.

We will respond to your request as soon as possible, within a maximum of one month from receipt, unless the request is technically complex or we receive a large number of requests at the same time. In such cases, the response time may be up to three months.

Please note that we may refuse to respond to any excessive or unfounded requests, particularly if they are repetitive in nature.

Can your personal data collected via our cookies be transferred outside the European Union?

The statistical and advertising cookies we use may send your IP address and user ID outside the European Union in order to function. In such cases, we guarantee that these tools strictly comply with the applicable rules on data transfers to ensure the confidentiality and adequate protection of your personal data.

The exempt statistical cookies we use are anonymised. As such, no data is transferred outside the European Union.

Who can you contact for more information about the use of your personal data?

To best ensure the protection and integrity of your data, we have officially appointed an independent Data Protection Officer (“DPO”) with our supervisory authority.

You may contact our DPO at any time, free of charge, at gdpr@emyosound.com to obtain further information or details on how we process your data.

We may amend our Cookies Policy at any time to bring it into line with new legal requirements and any new processing operations we may implement in the future.
